A Special NIA court in Mumbai on 27th December discharged all charges against Sadhvi Pragya, Lt Col Prasad Shrikant Purohit and two others under Maharashtra Control of Organised Crime Act, 1999 (MCOCA) and 17, 20 and 13 of UAPA and arms act in the 2008 Malegaon blast case.
However, Sadhvi Pragya and Lt Col Purohit to be tried under sections 120 B, 302, 307, 304, 326, 427 153 A of IPC, along with section 18 (conspiracy) of UAPA. The Court also gave clean chit to three other accused in the case namely Shyam Sahu, Shivnarayan Kalsangra and Praveen Takalki. All the accused are already out on bail and will continue to be on bail but their previous bonds and sureties to continue.
According to Special NIA Court, Sadhvi Pragya Singh cannot be exonerated of conspiracy charges as she was aware of the motorcycle being used for the conspiracy. On 29 September 2008, a bomb explosion aimed at sizeable Muslims living near Nooraji Mosque rocked Malegaon in Nashik district killing six persons and injuring 100 others. The next date of hearing is on 15th January 2018 in Special NIA Court in Mumbai.
