Amid nationwide celebrations on completing three years of BJP-led Narendra Modi government in the centre, the founders of partyâs stalwarts and former deputy prime minister Lal Krishna Advani, former Union HRD Minister Murli Manohar Joshi, present Union Minister for water resources Uma Bharti, VHP leader Vishnuhari Dalmia, former Bajrang Dal chief Vinay Katiyar, Sadhvi Ritambhara and others will have to face the trial for hatching criminal conspiracy, inciting the mob, promoting enmity between different groups on grounds of religion and disrupting communal harmony other offences for pulling down disputed Babri structure on 6th December,1992 at Ayodhya.
A Special CBI Court on 30th, May2017 has framed charges against many BJP and Sangh Parivar leaders. Though the name of Governor of Rajasthan and then Chief Minister Kalyan Singh also figured in the charge sheet filed by CBI for the offences u/s 120-B of IPC but due to constitutional protections he escaped the trial for a while. The court granted bail to all the accused on personal bonds of 50,000 each.
While framing charges to commence trial the presiding Judge S.K.Yadav of the Special CBI Ayodhya Court recorded its satisfaction that, â there is sufficient evidence on the records to frame charges against them under conspiracy and other charges.â Earlier the Supreme Court allowed the appeal of CBI against the orders of the trial Court and Lucknow Bench of the Lucknow High Court discharging these leaders from facing trial for criminal conspiracy for demolishing Babri structure.
Earlier on his arrival in Lucknow to appear before a special court in the Babri demolition case, BJP veteran L K Advani was greeted by Chief Minister Yogi Adityanath, his ministers and other party leaders on Tuesday morning. Rashtriya Swayamsevak Sangh (RSS) senior functionary Krishna Gopal also met him at the VVIP guesthouse where the latter stayed for a few hours. Deputy Chief Minister Keshav Prasad Maurya, Cabinet ministers Surya Pratap Shahi and Ashutosh Tandon, BJP state general secretary Sunil Bansal and with other leaders and MLAs received Mr Advani at the Lucknow airport. BJP leaders participated in court proceedings calmly but their supporters outside the court premises continued slogan shouting and chanting âJai Shri Ram.â
The excerpts of voluminous charge sheet filed by CBI exposes how these top BJP and RSS Parivar leaders are allegedly responsible conspiracy and that led to demolition and post demolition riots and violence all over the country.
The towering personality and top policy maker of BJP has been Advaniji who gave his sweat and blood to party for taking the reins of power by uniting Hindus of the country. He spearheaded Ram Mandir movement and involved various priests and saints to support and join his agitation. Prime Minister Narendra Modi accompanied him during his famous âRam Rath Yatra.â Having felt the burn of partition he dedicated himself for the cause of Hindus.
The CBI alleged that L K Advani âpassionately asserted constantlyâ that the kar seva to be held at Ayodha on December 6, 1992, âwould not mean only bhajan and kirtan, but would also involve construction of the Shri Ram temple.â âHe further asserted to Jansatta that the BJP will break the law for the construction of the Ram Janambhoomi temple at Ayodhya,â the charge sheet alleged. It adds that the final decision to demolish the disputed structure was taken on December 5, 1992, at âa secret meetingâ which was âheld at the residence of Shri Vinay Katiyar and was attended by Shri L K Advani, Pawan Pandey etc.â The charge sheet further states that during the same period, âKalyan Singh when contacted by a witness told him that rok construction per lagi hai, destruction par nahi (the stay is on construction, not on destruction).â
According to the charge sheet, L K Advani, in a public speech on December 6, 1992, had âin the proximity of the disputed structureâ and shortly before the actual demolition, said: âAaj kar seva ka akhri din hai, kar sevak aaj akhri kar seva karenge (Today is the last day of kar seva; kar sevaks will perform their final kar seva).â
While the demolition was in progress, the charge sheet says he acknowledged that âcentral forces were moving from Faizabad towards Ayodhyaâ but added that âthey were not afraidâ of them and âinstructed the public to block the national highway straightaway so that forces do not reach the Ram Janambhoomi.â
âAccording to the investigation, Murli Manohar Joshi had said at Mathura on December 1, 1992, on his way to Ayodhya that no force can stop construction of Ram temple and he was encouraging the kar sevaks from the podium on December 6, 1992, for the demolition of the disputed structure and was shouting provocative slogans.â
It was alleged in the charge sheet that Uma Bharti had âshoutedâ at Ram Janambhoomi Ayodhya on December 6, 1992: âEk dhakka aur do, Babri Masjid tod do,â and she had also advised the kar sevaks to demolish the disputed structure and shouted âMasjid girao, Mandir bano Babar ki aulad ko Pakistan bhagaoâ, âJinnah bole Jai Shri Ramâ etc.
âOn December 5, 1992,â it adds, âshe had told that kar seva will not mean only bhajan and kirtans but the start of a construction of the temple. âEk ek int prashad ke tor per lay jao (Take away each brick as prashad)â and âthat the Supreme Court had not told them to demolish but only to not do construction work and hence they are removing the black spot from the nationâs forehead.â
As per charge sheet on September 30, 1993, she had said in Silchar that the demolition of the Babri Masjid was âa part of a preconceived plan, and she was the pivot of the plan and gave the signal to break the Babri Masjidâ.
About the role of the then CM UP Kalyan Singh, the CBI alleges that at his swearing-in as chief minister of UP was done on June 24, 1991, Singh and senior BJP leader Murli Manohar Joshi visited Ayodhya along with members of his cabinet and party legislators, where they allegedly took a vow to construct the temple. The charge sheet states that Singh said that âin his tenure as Chief Minister, UP, a temple of Shri Ram will inevitably be constructed.â The CBI states that a conspiracy was hatched with the people being trained by the Bajrang Dal of Gujarat. The last day of training, it adds, was on October 10, 1991. In pursuance of this, Kalyan Singh, the CBI alleges, acquired 2.77 acres of land in October 1991 âunder the pretext of developing the same for tourism purposes.â
The charge sheet states âit is further evident from the investigation that Kalyan Singh in order to achieve the objectives of the criminal conspiracy as aforesaid not only failed to live up to its promises to protect the disputed structure but continued to aid and abet the criminal conspiracy to ensure its destruction.â It goes on to quote from Supreme Court orders, dated December 6, 1992, on it being a âgreat pityâ that a constitutionally elected government âcould not discharge its duties in a matter of this sensitiveness and magnitude.â
According to CBI charge sheet the accused public servants and Kalyan Singh were well aware that the central para-military forces were duly equipped with riot gear and plastic and rubber bullets to avoid casualties. âDogged refusal to deploy the said force in spite of several requests from the (Union government) shows that the failure to take these steps was a part of the conspiracy and criminal design,â it adds.
It is mentioned on page 45 of the charge sheet, Kalyan Singh made statements and gave public speeches which are âclearly indicative of his complicity in the demolition of the disputed structure.â The chargesheet states that on May 5, 1993, Singh said at Barabanki: âGoli na challaney ka aadesh unke dwaara hi jaari kiya gaya tha aur usi wajah se prashasan ka koi adhikari doshi nahi maana jayega (The order to not fire was issued by them. And that is why, nobody from the administration is guilty.â
On March 28, 1993, it adds that Singh said at Lucknow: âVivadith dhanche ki suraksha na kar pane ka unhe koye afsos nahi hai, kyonki ve 464 saal purana gulami ka chinh tha (They donât regret not being able to protect the controversial structure because it was a 464-year-old symbol of slavery).â
Other six accused who appeared before the CBI court included Ram Janmabhoomi Trust chief Nritya Gopal Das, Ram Vilas Vedanti, Baikunth Lal Sharma alias Prem Ji, Champat Rai Bansal, Dharma Das and Satish Pradhan. They have already been granted bail on previous hearings.
A day after charged were framed against BJP top leaders, the UP Chief Minister Yogi Aditya Nath visited Ayodhya on 31st May 2017 along with Mahant Dharmdas and visited Hanumangarhi temple, Ram Janmbhoomi temple and banks of river Yamuna.
