The plea also sought Delhi High Court’s directive to place the matter before International Court.
According to the plea, an Indian citizen was detained in an illegal manner. He is awarded death sentence by a Pakistani military court without giving him an opportunity of a fair trial, it added.
So far, Islamabad has rejected India’s requests for consular access to Jadhav.
The petition stated that the Indian government must challenge the violations of international law by the Pakistan government by taking the matter to the International Court of Justice. While this was so, Major General G D Bakshi while expressing apprehension that Jadhav might have already been killed by the neighbouring country through “insane torture” appealed
Last week, retired Major General G D Bakshi while expressing apprehension that Jadhav might have already been killed by the neighbouring country through “insane torture” had appealed to the government to file a habeas corpus in Pakistan courts to find out if Kulbhushan Jadhav is still alive.
“He was kidnapped, taken to Balochistan and tortured insanely to make him confess to all sorts of things which he did not do,” he said in a two-day convention on Nationalism and Patriotism organised by Veterans India,” he said.
Indian External Affairs Minister Sushma Swaraj had also warned Islamabad that the issue will damage the bilateral ties with New Delhi.
Jadhav is accused of being a spy and was arrested in March last year in the restive Balochistan province.
